Hey guys let’s just say there was a big Sticknodes convention and you attended. Let’s say I was there and I wheeled in a giant tank of water and some chains and a straight jacket because I intended to do a crazy Houdini trick in front of everyone. I’m in the water and I struggle for 2 minutes before the thrashing stops and the bubbles stop coming up. What would you do in this situation?

No, it’s not. Assuming the guy is American, his art is protected under the 1st amendment. It becomes a hate crime if he is doing it to threaten someone, or if he did something like trespass onto someone’s property and burned their gay flag. Burning a gay flag IRL, if it is your flag that you are burning on your property that you bought with your own money, is protected speech.
