No, it’s not. Assuming the guy is American, his art is protected under the 1st amendment. It becomes a hate crime if he is doing it to threaten someone, or if he did something like trespass onto someone’s property and burned their gay flag. Burning a gay flag IRL, if it is your flag that you are burning on your property that you bought with your own money, is protected speech.
